In the name of Allah, Most Gracious, Most Merciful. Below are comments made by Imam about divorce and custody of child in Islam (summarised): It is certain that the mother are entitled to the custody of the child, if the child is below nine years of age. Thereafter, the child may be offered a choice between his parents. The father remains responsible to provide him with his need of food, clothes and housing. If the couple divorced and the child is with the mother, the father is entitled to visit the child or have the child visit him. The same applies to the mother. In Islam there is no denial of access to the child to either parent, unless there is a valid reason determined by the court. There are many considerations that a Muslim judge looks at before giving custody to one of the parents. In all cases, this is a matter that will have to be dealt with in court or through an arbitrator or a mediator. If the mother/father are worried about that is to raise the child as a good muslim is extremely important and the parents should do his/her best to gather all of the evidence along with the best lawyer or witnesses they have to gain custody over the child. The matter could be solved peacefully and without going to court, because courts could be draining to emotions and finaces too. If the couples are not satisfied with the out-of-court settlement and he/she believe the the court system can get them a more favourite settlement, then go ahead with it. But first, try a mediator who really cares about both of the couples and the child and who has the wisdom to end this marriage with minimum harm to both of them. Custody for the children in Islam is given to the mother when the children are very young. This is on the condition that the mother does not marry again. When the child reaches an age when he or she no longer needs to be looked after by the mother, then he or she is given the choice to join either parent until a boy attains puberty or a girl gets married. Assalamualaikum, I gave some details about this NOT as encouragement but just to give guidance to those who are having these problems. The number of divorces is not small. Whether the matter is divorce or marriage, we must not forget the Islamic rulings, because we need to answer everything in the Day of Judgement........ ALLAH KNOWS BEST.
